Survey results and a significant event that took place in June put the spotlight on the outlook for the consumer goods manufacturing and retail industry – with both negative and positive outcomes. The latest EY/Bureau for Economic Research (BER) Retail Survey found a sharp deterioration in the business confidence levels of retailers during the 2016 second quarter. The Consumer Goods Forum (CGF) Global Summit which took place in June in Cape Town with a formidable list of international speakers showed that, whilst we may be heading for the end of retailing as we know it, a new phoenix is rising out of the ashes to catapult us into a new world order.

It Came, It Conquered, Now It's Packing Up and Leaving. That’s how Bloomberg reporter Shannon Pettypiece (twitter.com@spettypi) reported on Wal-Mart’s announced plan to shut down 154 stores in one month. She focused on one small town - the Town ’n Country grocery in Oriental, North Carolina. A local fixture for 44 years, it closed its doors after a Wal-Mart store opened for business. Now, three months later -- and less than two years after Wal-Mart arrived -- the retail giant is pulling up stakes, leaving the community with no grocery store and no pharmacy.

  FASA PRACTICE NOTE – SECTION 197 OF THE LABOUR RELATIONS ACT
 


 
 

The termination of a franchise agreement by the franchisor does not in itself constitute a transfer of a business as a going concern, even if the franchisor thereafter appoints another franchisee in the same area, and serving the same customers, as the previous franchisee. Therefore, the new franchisee is not obliged to take over the rights and obligations of the previous franchisee towards its employees, as is required in terms of section 197 of the Labour Relations Act on the transfer of a business as a going concern.
