JOINING FASA

Effective 1 January 2017

FASA, as the official body for franchising in South Africa, has, as the underlying basis on which membership is granted and controlled, a Code of Ethics and Business Practices to which all members subscribe.

MEMBERSHIP CRITERIA

Please take note of the following information which applies to all applicationsfrom franchisors and service providers
members:-

  • All applications are forwarded to FASA's membership committee for comments and final approval, where applicable.
  • The entire approval process takes between 4 and six weeks from date of submission depending on the number of questions or suggested amendments raised by the membership committee and the applicant's response time.
  • The annual membership fees are R15,495.00 (excluding VAT). A once-off legal fee of R4,495.00 (excluding VAT) is payable in respect of franchisor membership applications only. Please note if the applicant's franchise agreement was written by a franchise attorney who is a member of FASA, the legal fee is waived. FASA membership is granted in 6 categories:-

  1. Franchisor membership
  2. Preliminary membership for new and Developing franchise companies
  3. Professional service provider membership
  4. Franchisee membership
  5. Individual membership
  6. Product supplier membership

FRANCHISOR MEMBERSHIP

Full membership to companies who are franchisors. A thorough assessment of each applicant company is made before membership is granted. This would typically include a look at the viability of the concept as well as the presence of appropriate documentation, with the minimum requirements being:-

  • Disclosure document that complies with FASA's stringent specifications
  • Fair and reasonable franchise agreement that clearly reflects the spirit of FASA's Code of Ethics and Business Practices
  • Has a comprehensive operations and procedures manual
  • For full membership, the franchised concept must have been in operation successfully for two years in South Africa.
  • International franchised concepts that are members of their respective country of origination's franchise association do not automatically qualify as members of the franchise association in South Africa.

The submission documents must include the following:-

  • The membership fees are R15,495.00 (excluding VAT) per annum payable on submission of the membership application documents plus a once-off legal fee of R4,495.00 (excluding VAT). The legal fee is waived if the applicant's franchise agreement was written by a franchise attorney member of FASA.

  • Franchise Agreement
  • Operations Manual - kindly submit the contents pages of the manual only, provided the information contained in the manual is described in detail in the index or contents of the manual.
  • Contents pages provided the information is detailed
  • Disclosure Document. The Disclosure Document must include financial statements of existing franchised outlets so that prospective franchisees can evaluate the financial viability of your concept. See requirements for the disclosure document.
  • Member's Declaration form - this document must be printed on the applicant company's letterhead, duly completed and signed by the correct or relevant representative of the applicant's company. Members Declaration form. Please copy the text in the linked document and paste it on your company letterhead.
  • A copy of the latest financial statements of the franchise company
  • Details required for your free entry in the annual Franchise Manual, website and Supplier Manual.

Kindly note that the Application form for Franchisor Membership must be completed manually as the association requires a record of the applicant's signature.

PRELIMINARY MEMBERSHIP - DEVELOPING OR NEW FRANCHISE COMPANIES

Preliminary Membership to companies wishing to franchise their businesses. A thorough assessment of each applicant company is made before membership is granted. The minimum requirements being:-

  • has a disclosure document that complies with FASA's stringent specifications
  • has a fair and reasonable franchise agreement that clearly reflects the spirit of FASA'ss Code of Ethics and Business Practices
  • has a comprehensive operations and procedures manual

The submission documents must include the following:-

  • The membership fees are R10,190.00 (excluding VAT) per annum payable on submission of the membership application documents plus a once-off legal fee of R4,495.00 (excluding VAT). The legal fee is waived if the applicant's franchise agreement was written by a franchise attorney member of FASA.

PROFESSIONAL SERVICE PROVIDER MEMBERSHIP

This category is open to professional practices that wish to provide professional services of high ethical standards to the participants in the franchise sector. These include law firms, banks, insurance companies, franchise consultants, brand and marketing companies, IT companies and many others. In order to complete your membership application, a service provider application form has to be completed, signed and submitted together with a member's declaration document. Please note this document must be printed on the applicant company's letterhead, duly completed and signed by the correct/relevant representative of the applicant company.

If you are applying for Professional Service Provider Membership, you have to complete the following 3 documents:

FRANCHISEE MEMBERSHIP

Franchisees can enjoy all the usual benefits as well as receive invites to attend workshops, seminars and networking events. Franchisees who are paying members of the association has voting rights and can nominate themselves to serve on the association's council and working committees.

The membership fees are R520 plus VAT per annum if your franchise company is a member of the association and R800 plus VAT per annum if your franchisor is not a member of the association.

INDIVIDUAL MEMBERSHIP

Individual Membership is for individuals in the industry wishing to attend industry events to network and improve their education and knowledge base on franchising. Members benefit from membership discounts at events.

Membership fees are R520.00 excluding VAT per annum per person.

This category is for product suppliers that wish to be recognised for their ethical and professional product supply services to the franchise industry.
The following should be the same as for the professional supplier membership category I.e. If you are applying for Product Supplier Membership, you are required to complete the following documents:-
